The U.K. introduced sweeping changes to its internet gambling laws with the passage of the Gambling Act of 2005. The stated purposes of the act were very noble: to prevent gambling from being a source of crime and disorder; to ensure gambling would be conducted in a fair and open manner; and to protect children from being harmed by enforcing the legal gambling age of 18 years. In practice, of course, the act led to a surge in onsite operators moving to the country and a corresponding increase in tax revenues as a result.

In the U.S., the situation is much different. Gambling is legal under Federal law but prohibited in many states, with some local exceptions. Legal gambling states include Nevada and New Jersey, although many states have passed laws that legalize gambling in certain municipalities as well as on Native American lands. Internet gambling laws, on the other hand, have effectively prohibited operators from doing business within the states.

In 2006 Congress approved an act that dramatically affected the internet gambling laws and effectively proclaimed the industry illegal. That act threw the industry into turmoil, and drove virtually all of the U.S. based operations out of the country. Sites operated out of the U.K. and the Bahamas now garner a majority of this profitable business. But numerous faults in the 2006 legislation and the feeling that Congress has more important things to worry about have now pushed the country to the brink of legalizing the industry.

If the U.S. is to proceed with the legalization of gambling over the internet, congress must first do away with its awkward attempt at making it illegal under the 2006 Unlawful Internet Gambling Enforcement Act (more easily referred to as UIGEA). The purpose of that act was fairly simple: make it illegal for banks, credit card companies, and other payment processors to transfer funds from gamblers to online casinos and from those online casinos back to the gamblers.

You must understand, however, that the preference of lawmakers has always been to prohibit online gambling. But concerns about the constitutionality of such a prohibition as well as the mind boggling problems associated with enforcing the ban have consistently killed any possible actions along those lines. So Congress chose instead to try to attack the problem by preventing the flow of capital between the gamblers and the casinos under the UIGEA.

Now, thanks in no small part to the national financial meltdown, Congress is poised to reverse its approach to internet gambling laws and scrub the problem-plagued UIGEA. Under a couple of proposed House bills including one sponsored by Barney Franks and Ron Paul, Congress now appears poised to legalize and regulate the industry.

Whenever Congress actually considers such a sensible approach you can assume that there are potential tax revenues to be gained. So it shouldn’t come as a surprise to learn that one of the major benefits of legalized gambling is additional revenue for the government. Recent studies have indicated that the tax revenues the government stands to reap from a legalized online gambling industry could reach more than billion over the next 10 years.

Hopefully, based on current sentiment in Congress regarding internet gambling laws, U.S. based online gambling fans will soon be able to enjoy their sport legally through U.S. based operations that will be under the scrutiny, and taxing power, of the Federal government.

Let me clarify that last point, all the act does is enforce the current legislation by telling financial institutions that they are responsible if the money they handle comes from a site that broke US laws in the first place.So what is the Definition of Unlawful Internet Gambling?Section 5362(6) defines unlawful Internet gambling to mean, placing or receiving a bet “where such bet or wager is unlawful under any applicable Federal or State law.”, if it was not illegal before, it still isn’t.The main problem is that internet gambling is illegal, (to a various degree) in 11 states, so now the banks have to make sure that they don’t pay sites that accepted this illegal money.Sports-betting was made illegal way back in 1961 by the Wire Act, but internet gambling is not.Where on earth.Another major drawback of the law is the jurisdiction, the US congress doesn’t have jurisdiction to make rules for a company that resides offshore.Nor does the US have subpoena power to command an offshore company to turn over records. In the House of Representatives, there is a bill (H.R. 4777) that was introduced by Representative Bob Goodlatte, of Virginia. The bill, entitled “Internet Gambling Prohibition Act”, was introduced to the House of Representatives on February 16, 2006 and was sent to the Committee on the Judiciary on the same day. The bill is one that, if passed, will affect all Americans who want to be able to gambling online–it will affect those promoting gambling oriented affiliate programs too.

The Path

It’s first important to point out that the path of this bill become official United States law is a long and difficult one. The bill has to go through many steps in the House first. H.R. 4777 has 129 cosponsors, which is roughly 25% of the representatives in the House. It does have a good shot at passing the House in the coming months.

If it passed in the House, it will be sent to the Senate, where it will have to undergo the same process as it did in the House. The bill will be sent to a committee, reports will be written and so forth. If not even one word is changed and no rider is attached, it will be placed up for vote. Should even one word be altered or a rider attached, it will need to repeat the cycle at the House of Representatives.

Should the bill be one of the few that survives this path, the President will have to sign it into law or veto it. If the bill does not make it all this way before the current session ends, the bill is quashed and will need to be re-introduced next session and start all over again.

The Bill

This main purpose of this bill is to make online gambling illegal and to make sure the language of the text includes the Internet and not simply “phone lines.” H.R. 4777 seeks to amend Section 1081 of Title 18 of the United States Code. Here’s a breakdown of the language updates.

1.”wire communication facility” will be replaced with “communication”.2.”aid of wire, cable,” will have satellite and microwave added to the list.3.”other like connection between” will have “(whether fixed or mobile)” added to the description.4.Adding definitions for: bet or wager, gambling business, money transmitting service, money transmitting business, foreign jurisdiction, and others.

The bill will amend Section 1081 to be stronger and more complete. The whole concept is to do away with limiting terms like “wires” and replace it with an all-encompassing term like “communication facility”. That way the law remains strong no matter what inventions the future holds.

Conclusion

The bill has a long way to go to become law, but if it does, it will strengthen Section 1081. Gambling online in the United States is already technically illegal, but it’s a law that’s not really enforced. The question remains; will this improvement matter at all if the law is not being enforced anyway? Only time will tell, but the coming months should be very interesting. The United States is also battling the WTO, because of the U.S.’s stand on online gambling–it’s can’t be fully regulated and taxed by the U.S., so they don’t like it.

And again, there is no expectation that states would pursue the gambler rather than the gambling company. But if you have any concerns, you should check with your state’s gaming commission to understand whether or not you are violating any state laws.
